JAMIE LYNN STUDIO - TERMS AND CONDITIONS

PLEASE READ BEFORE BOOKING :

All sessions must be paid for 24 hours before shoot date. This is a new policy I will be implementing to help avoid last minute cancelations and to ensure that I am able to get as many of my clients fully through their sessions.

 When booking your session 50% of the total amount is due for your session to be held, a reminder will be noted to pay in full 24-hours before our shoot. This also helps day of shoot go easier for both parties knowing payment has already been taken care of. 

Last minute cancellations are acceptable 72 hours prior to the shoot date unless otherwise discussed. Past this date must rebook your shoot date but 50% of the original booking can be applied to the rescheduling. The date for rescheduling must be secured within 7 days of rescheduling or you will forfeit the 50%.

Clients are responsible for letting me know what their goals are for the session and to ensure that I have received inspo or a brief from them to have the best possible outcome for the shoot.

ALL studio rentals or location rentals fall on the responsibility of the client and is an additional charge unless otherwise agreed upon in writing from both parties.

I do provide services outside of my listed packages, if there is something you are wanting or wondering about that you don’t see don’t hesitate to reach out to me. I am more than happy to work with you along the process if this is what you need! Im here to help, so use me!

Payment plans are available if needed, I just ask that payments be done by our shoot date unless otherwise discussed.

Print release form and contract must be signed before shoot date.

Additional images are available for purchase.

If you are interested in purchasing the raw images, meaning you will have access and have all the images from the shoot to use as you wish I do now offer this as an additional charge, these images cannot be sold or published without my consent, however, may be used and altered as you wish. The cost of this will change depending on the project you have booked me for.

All wedding or engagement inquiries will begin with a briefing so we can get to know each other, I want to make sure if you are considering me for a wedding or engagement that you feel confident and comfortable with me being a part of your special day so I can help ease your nerves going into the day knowing everything you want will be captivated. This is why I don’t offer packages for wedding or engagements rather we will build it together off of your wants and needs.

Rescheduling:

- A minimum of 72 hours notice is required for rescheduling.

- Rescheduling is subject to availability and cannot be guaranteed near the original date.

- Exceptions may be made for emergencies or COVID-19 related issues.

- If weather impacts a shoot and an alternative venue is not available the shoot will be rescheduled for another date.

Packages and Pricing:

- Listed prices are for individual sessions.

- Additional costs apply for multiple subjects or group shoots.

- Brands and events: Base rate starts at $850, with additional hourly rates applied.

Consultations:

- Brand and event shoots require a consultation before final pricing.

- I reserve the right to decline projects if I cannot meet your vision.

Contracts and Model Release:

- All clients must sign a model release form and contract prior to the shoot.

- Jamie Lynn Studio retains the right to use images for portfolio and promotional purposes.

- Clients who do not wish to allow image sharing may be referred to other photographers.

Image Delivery:

- Turnaround time for edited images is 2-3 weeks after the shoot.

- High-end retouching is included in designated packages only, taking 20 minutes to 2 hours per image.

Film Photography:

- Film shoots are available upon request for an additional fee.

- Costs for film and development will be billed post-shoot.

- Film shoots may have a quicker turnaround time.

Limitation of Liability:

- Jamie Lynn Studio's liability is strictly limited to the amount paid for the photography services.

- While we take all reasonable precautions, Jamie Lynn Studio is not liable for any indirect, consequential, or incidental damages arising from the photography services or the use of the images.

- Clients agree to indemnify and hold Jamie Lynn Studio harmless against any claims arising from their use of the images.

- This limitation of liability does not apply to any damages caused by gross negligence or willful misconduct.

Collaborations:

- Collaborative shoots are by invitation only and limited to 5 images per collaboration.

Copyright and Usage:

- Jamie Lynn Studio retains full copyright ownership of all images produced during the session.

- Clients are granted a limited, non-exclusive license for personal use of the images.

- This license does not include the right to sell, publish, or use the images for commercial purposes without express written permission from Jamie Lynn Studio.

- Any unauthorized use, reproduction, or distribution of the images is strictly prohibited and may result in legal action.

Cancellation Policy:

- There are NO REFUNDS on deposits once a date is booked.

Additional Notes:

- Jamie Lynn Studio invests continuously in growth and equipment to provide the best experience for clients.

- I put my heart into making you feel amazing and look your absolute best.

- I aim to showcase my work to gain momentum and grow my following.

Dispute Resolution:

- In the event of any dispute arising from or relating to these terms or the photography services, the parties agree to first attempt to resolve the dispute through good-faith negotiation.

- If negotiation is unsuccessful, both parties agree to mandatory mediation before pursuing any other legal remedies.

- Mediation shall take place in Maricopa County, Arizona, with a mutually agreed-upon mediator.

- The costs of mediation shall be shared equally between the parties unless otherwise agreed.

- If mediation fails to resolve the dispute, either party may then pursue legal action in the courts of Maricopa County, Arizona.

Jurisdiction:

-  These terms and conditions shall be governed by and construed in accordance with the laws of the State of Arizona. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts of Maricopa County, Arizona.
